Sales conditions

The sales conditions apply to the sale of goods and services on M35.no to consumers.

Seller: M35.no (M35 Collective AS) or in the case of intermediary sales of art, M35 (M35 Collective AS) act as an intermediary on behalf of the artist who is the counterparty to the contract. 

Buyer: The person named as the buyer in the order.

We reserve the right to typographical errors, stock errors, out-of-stock items and logical errors on our pages. 

At M35.no you can buy art and frames. In order to make a purchase, you must accept the terms of this agreement and follow them in their entirety.

The relevant terms and conditions of sale, together with your order, will form an overall contractual basis for the purchase. M35.no only delivers to mainland Norway.

Consumer purchases are regulated, among other things, by the Consumer Purchases Act, the Right of Cancellation Act, the Marketing Act, the Personal Data Act and the E-commerce Act, which you can find here https://lovdata.no/.

  1. Order and agreement process

    Your order is binding when the order is registered with us. You still have the right to withdraw from the purchase in accordance with the Act on the right of withdrawal, see clause 6 of the agreement in more detail. We reserve the right to cancel your order or parts of it, if the product is sold out. If an item is sold out, you will be notified of this, possibly together with information about what we can offer instead.

 

  1. Prices
    The total cost of the purchase will appear before the completion of an order and include all costs associated with the purchase such as costs for shipping and packaging. The prices are constantly changing and we reserve the right to change prices until the completion of each individual purchase.

    When buying art mediated by M35 on behalf of the arts, there is no VAT on the artwork. You can read more about art & VAT her

    When buying art sold as resale, or framing, there is VAT.


  2. Payment
    The seller can demand payment for the item from the time it is sent from the seller to the buyer.

    If the buyer uses a credit or debit card for payment, the seller can reserve the purchase price on the card when ordering. The card is charged on the same day the item is sent.

    When paying by invoice, the invoice is issued to the buyer when the goods are dispatched. The payment deadline appears on the invoice.

    Buyers under the age of 18 cannot pay with a subsequent invoice.

  3. Delivery
    All general delivery times stated on m35.no are indicative. The number of working days is weekdays. If no delivery time is stated in the order solution, the seller must deliver the goods to the buyer without undue delay and no later than 30 days after the order from the customer. The goods must be delivered to the buyer unless otherwise separately agreed between the parties.

    Items that are pre-ordered have different delivery times. If something has a particularly long delivery time, this is stated in the description of the product. 

    Delivery has taken place when the buyer, or his representative, has taken over the item.

  4.  Right of withdrawal
    The Right of Cancellation Act gives you the right to cancel your purchase. The right of withdrawal applies to goods and to certain services (see exceptions in the last section). The right of withdrawal requires that you notify m35.no of this no later than 14 days after you receive the delivery (withdrawal period).

    All products must be returned to the Seller within a reasonable time when using the right of withdrawal. The goods must be returned to the Seller named in the delivery confirmation that contained the goods.

    You bear the risk for the transport of the goods back to M35.no. The product is sent back to the Seller in the original packaging, together with a completed right of withdrawal form. The return must be made to M35.no in accordance with the terms.

  5. Delay in delivery
    If the Seller does not deliver the item, or delivers it too late in accordance with the agreement, and this is not due to you or circumstances on your part, you may, in accordance with the rules in the Consumer Purchase Act, Chapter 5, depending on the circumstances, withhold the purchase price, demand fulfillment, terminate the agreement or demand compensation from m35.no

  1. Complaints and warranty
    After you have received the products, you should as soon as you have the opportunity, within 2 months, check whether the delivery is in accordance with the dispatch confirmation. Investigate whether the products have been damaged during transport, or whether the products otherwise have errors or deficiencies. If an error or deficiency is discovered, you must, within a reasonable time after you discovered, or should have discovered it, give M35.no a written notice of complaint in in accordance with Section 30 of the Consumer Purchase Act.

  2. Guidelines for privacy
    By accepting our sales conditions, you also give your consent to store and process your personal data. M35 Collective AS is the data controller.


  3. Change in the terms
    We reserve the right to change these terms and conditions, including as a result of changes in legislation.


  4. Conflict resolution
    Complaints should be addressed to M35 within a reasonable time, cf. points 9 and 10. The parties must try to resolve any disputes amicably. If this is not successful, the buyer can contact the Consumer Council for mediation. The Consumer Council is available on 23 400 500 or www.forbrukerradet.no.
